These Terms of Service ("Terms") govern your use of the TrailParks platform ("Platform") as a trail park. By using the Platform, you agree to these Terms. If you disagree with any part of the terms, you may not use our services.
TrailParks is an online platform for listing information related to trail parks and selling adventure/trail related items, including but not limited to snacks, coffee, apparel, tents and other kit, trail access permits, and accommodation.
3.1. TrailParks reserves the right to choose what may be listed for sale on the platform.
3.2. The sale of alcohol is strictly prohibited on the platform.
3.3. Any items or content associated with religions other than Christianity as described in Scripture are prohibited.
3.4. Parks are responsible for maintaining the accuracy of their listed information. It is the park's responsibility to inform TrailParks of any changes to their details.
4.1. TrailParks is not responsible for any injury or harm that anyone encounters as a result of items purchased or activities embarked on via the platform.
4.2. TrailParks is not responsible for maintaining the accuracy of any information that the parks list.
TrailParks reserves the right to terminate the relationship with a park if any of these guidelines are not adhered to.
Should these terms of service be updated, parks will be informed.
7.1. TrailParks will not make visitor contact details available to parks for marketing purposes other than what is provided as functionality through the TrailParks platform.
7.2. Should visitor details be required on the basis of indemnity, a request can be placed in writing by the trail park by emailing TrailParks. If it is found that this is not a valid indemnity dispute scenario, TrailParks reserves the right to terminate its relationship with that park.
8.1. Parks can opt into shop functionality by purchasing a monthly subscription.
8.2. Pricing is handled on a tiered basis where parks agree to pay a monthly fee to sell products.
8.3. The monthly fee covers a monthly revenue threshold. Any revenue above that threshold will incur an additional cost based on a predetermined percentage of monthly revenue above the threshold.
8.4. Both the threshold and over-threshold percentage will be communicated as part of the tier that the park selects when choosing to purchase a monthly subscription.
8.5. Payments will be made to parks on a weekly basis if they have a balance of five hundred Rand (R500) or more. If the balance is lower than five hundred Rand (R500), the weekly payment will be withheld until the balance reaches five hundred Rand (R500).
8.6. Should the weekly withdrawal threshold not be reachable for several weeks, a park may request that their current balance be paid out to them.
8.7. All payments will be made to the bank account provided by the park to TrailParks. It is the park's responsibility to ensure that the provided bank account information is accurate and up to date.
8.8. TrailParks expects parks to pay the monthly subscription fee separately. This fee will not be automatically deducted from the funds that parks accumulate on the platform through the shop functionality, except in scenarios of non-payment as outlined in Section 9.
8.9. Costs related to exceeding the subscription tier's monthly revenue threshold will be automatically deducted when the park's fees are paid out.
9.1. Payment Terms:
a. Payments for the shop functionality will be carried out monthly on the date of the original purchase.
b. If a payment is missed, the park has until the next payment date to pay the missed payment.
c. Payouts to the park will be paused during this grace period.
d. If a second payment is missed, the shop functionality will be deactivated.
e. Any funds the park still had on TrailParks will be used to settle all outstanding fees owed to TrailParks. This includes both the monthly subscription fees and any over-threshold costs.
f. Any remaining balance will be paid out to the park.
g. TrailParks has seven (7) days to provide the park with proof of payment for these fees (if any).
9.2. Subscription Updates and Cancellation:
a. Parks may cancel or update their shop subscription at any time.
b. Changes will take effect from the next payment date.
c. If a park cancels their shop functionality, the cancellation will be processed on the date when the next subscription payment would have been due had the cancellation not taken place. This date will serve as the "deactivation date". No payment will be required from the park on this date due to the cancellation.
d. On the deactivation date:
i. The shop functionality will be deactivated.
ii. Any outstanding fees will be settled.
iii. Any remaining balance will be paid out to the park.
e. TrailParks has seven (7) days from the deactivation date to provide the park with proof of payment for any fees settled or balances paid out.
9.3. Deactivation of Shop Functionality:
a. Deactivation involves removing the park's shop page and navigation links from the TrailParks platform.
b. Any orders placed by visitors will remain visible in their order history.
c. Any products will remain active for their normal duration as specified at the time of purchase.
9.4. Pricing Updates:
a. TrailParks reserves the right to update the shop subscription pricing, including monthly fees and thresholds.
b. Changes will be of immediate effect for any new subscriptions.
c. Parks with existing subscriptions will receive one (1) month's notice via email.
d. The change will take effect on each park's earliest payment date after the notice period ends.
By using the TrailParks platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
